An hour long analysis of the paucity of case law on one of the biggest issues in criminal law ethics. What are the attorney's options?  What is the interplay between an attorney's ethics and a client's constitutional rights?  What are the difference, if any, between civil and criminal cases 
 

B. Scott Westhas served the Kentucky Association of Criminal Defense Lawyers (KACDL) in numerous roles. In 2019, he was elected President of the organization and currently serves on its Board as President Ex Officio. From 2016 to 2019, he served as KACDL’s Education Chair, and in 2025, after retiring from the Department of Public Advocacy, KACDL was lucky that he stepped up once again to advocate in a new role as the KACDL Legislative Advocacy Director.

Scott began his career at Texaco in Houston, spending ten years as in-house litigation counsel, handling cases ranging from personal injury to oil and gas disputes. Returning to Kentucky, Scott joined the Department of Public Advocacy (DPA), rising to become General Counsel and Deputy Public Advocate while focusing on criminal cases.

Throughout his distinguished career, Scott has been a dedicated educator, teaching at DPA’s Annual Conference, Kentucky Bar Association Conventions, and various other venues. He’s gained national and international recognition for his pretrial bail advocacy, speaking in multiple states and contributing to bail reform efforts in Armenia. As the original editor of DPA’s Bail Advocacy Manual and founder of the Bail Advocacy Workgroup, Scott has made significant contributions to this critical area of criminal law.
