The DOC has implemented HB 5 by retroactively changing parole eligibility based on the sentencing date, rather than the offense date. This session will discuss DOC's decision, and statewide attempts to address the issue through litigation. Issues will include a discussion of retroactivity law, the status of current litigation, advice to give clients who may be affected by DOC's decision, and what issues to be aware of that your court may entertain in light of DOC’s actions.

Please note: This is the same seminar presented at the 2025 DPA Annual Conference, as such, we are making this available to the first twenty five (25) DPA members that register at zero cost. Registration is required. FCFS.

 
Tim Arnold graduated from Knox College in Galesburg, IL, in 1993, and from the University of Kentucky College of Law in 1996. After joining the bar, Tim started as an attorney in the Juvenile Post Dispositional Branch of DPA in the Frankfort office, and served as the Branch Manager of JPDB from 2004-2008. From 2008-2023 he served as the DPA's Post Trial Division Director. He now works as an attorney in DPA's Appeals Branch.
