Federal Sentencing Guidelines and Practice Tips

The first part of this presentation will include a discussion about federal sentencing calculations with an in-depth conversation on the federal sentencing guidelines.  The second part of the presentation will include practice tips and common sentencing pitfalls to avoid.  Topics will include base offense level calculations, criminal history calculations, grouping issues, enhancement issues, and armed career offender/career offender/851 enhancements

Alex Stewart is an alumnus of Western Kentucky University, located in his hometown of Bowling Green, Kentucky. He earned his Bachelor of Arts degree studying Philosophy and History, and he graduated magna cum laude from the WKU Honors Program in 2013. He earned similar distinction at the University of Kentucky College of Law, from which he graduated magna cum laude in 2018. While in law school, Alex won awards in trial advocacy and appellate oral advocacy competitions and was a member of the Trial Advocacy Board. During the 2017-2018 school year, Alex obtained a student practice license and worked at the University of Kentucky Legal Clinic providing pro bono legal services to indigent members of the community. For his work at the Clinic, Alex received a CALI award, an award given to the top-performing student in each course. During his time at the University of Kentucky College of Law, he was awarded four additional CALI awards for classes including Constitutional Law I and II. Alex finished in the top of his class and was admitted to the Order of the Coif upon graduation.

Alex focuses his practice on criminal defense and has an ever-expanding federal appellate practice. He has experience in all manner of felony and misdemeanor cases in state court and has helped Nash Marshall serve a wide variety of federal criminal clients as well. He is proud to represent select indigent clients as a member of the Sixth Circuit Court of Appeals’ Criminal Justice Act appellate panel.

He has experience in the areas of State Criminal Defense, Federal Criminal Defense, Appellate Practice, Expungements, and Subpoenas, Internal Investigations & Special Matters.

Alex is admitted to practice before all Kentucky courts, including the Kentucky Supreme Court. He is also admitted to practice in United States District Court for the Eastern and Western Districts of Kentucky, plus the United States Court of Appeals for the Sixth Circuit.

David S. Hoskins, KACDL President Emeritus (2012), is an attorney who represents clients in the Corbin, Kentucky area. David Hoskins is recognized by peers and was selected to Super Lawyers for 2015 - 2023. This selection is based off of an evaluation of 12 indicators including peer recognition and professional achievement in legal practice. David Hoskins chose to pursue a career in law after completing undergraduate studies. He attended Wake Forest University School of Law and graduated in 1984. David Hoskins passed the bar exam and was admitted to legal practice in 1984.  He represents clients with Criminal Defense issues in Kentucky. He also represents clients with Civil Litigation: Plaintiff issues. Being selected to Super Lawyers is limited to a small number of attorneys in each state. As one of the few attorneys to garner the distinction of Super Lawyers, David Hoskins has earned the respect of peers as one of the top-rated attorneys in the nation. 

 


Abe Mashni, KACDL Board Member and Education Chair,  is the founding attorney of Mashni Law, PLLC.  He focuses his entire practice on defending those accused of violating state and federal criminal laws, students and faculty accused of violating university code of conduct rules, and licensed professionals accused of misconduct. 

BACKGROUND + EXPERIENCE

Born and raised in Lexington, Kentucky, Abe graduated magna cum laude with a Bachelor of Arts in Political Science.  He earned a Juris Doctorate from the University of Kentucky College of Law and subsequently passed the Kentucky Bar exam in 2013.

After graduating law school, Abe began working for Fayette Circuit Judge Kimberly Bunnell as a staff attorney.  In 2014, he joined a Lexington law firm.  In 2019, Abe earned partnership stake in the firm.

In 2022, Abe founded Mashni Law and the mission is clear - to defend the innocent, seek mercy for those who have made mistakes, and protect clients’ rights by ensuring they are treated in accordance with the standards and principles of justice.  Abe has successfully tried several cases to jury.  His jury trial experience includes federal drug trafficking and firearms, state felony crimes, state misdemeanor crimes, DUIs, and personal injury.
